At Kaylee Davis Fitness LLC, hereinafter referred to as “Company,” we respect and honor our clients privacy and personal information. Our goal is to help build confidence in women either thinking about starting a family, currently pregnant, postpartum or just looking to work out with other women through either group fitness classes or our program ‘Moms in Training.’ Within this Privacy Policy you will learn the types of information we may collect when using our website and how we will use, maintain, store and protect your personal information. 

SECTION I- INFORMATION WE COLLECT/ HOW IT’S USE

The personal information we collect is helpful in determining which services are best for you and how we can best supply them to you. Below is a list of the types of information we collect from you.

  • Name and contact information such as first and last name, email address, physical address and phone number. 

  • Gender

  • Date of Birth which is used to determine age appropriate workouts for you. 

  • Card information such as a card number, expiration date, if credit or a debit card and the security code. This would be collected at the time of payment for the use of our fitness programs.

  • Account Credentials such as passwords and other security questions for authentication and access to our website and other services. 

  • What type of birth you had, which is used to determine ways to target your fitness routine.

  • How far along you are within your pregnancy, which is used to determine a safe fitness routine for you. 

  • Any conditions you may be experiencing while currently pregnant, which will allow us to focus on those areas within your fitness routine.

  • If you already have had a child and if so when, which will allow us to determine better assist you in forming your work- out routines. 

We may also collect the information described above and use it for the purpose of internal research & development pertaining to programming offered. This research & development will be performed by Kaylee Davis Fitness LLC, and/or a contracted third party provider working on behalf of Kaylee Davis Fitness, LLC to further improve our offered products and services.

We reserve the right to anonymize the data we collect and report it as part of an internal “study” conducted by Kaylee Davis Fitness, LLC. This anonymized data may end up being sold or integrated into other third party studies or materials for marketing purposes. Under no circumstances will your name or any other identifiable personal information be included in such data. 

SECTION II- REASONS WE COLLECT PERSONAL INFORMATION 

The purpose of our collection of your personal information is to help deliver you the best and most customizable fitness experience. In addition, by collecting your personal information, we are also able to provide you news and analysis about the program using our periodic newsletter. However, if an individual does not want to receive this newsletter, they are able to unsubscribe to these notifications by scrolling down to the bottom of the newsletter received through their email and click on the “unsubscribe button.” 

SECTION III- WHEN WE DISCLOSE YOUR INFORMATION 

Here at Kaylee Davis Fitness LLC, we take your privacy very seriously. We do not sell or rent your personal information to other marketers however, we do use a few data software companies who also have access to your information. These programs do not sell or rent your information that is accessible to them. However, they operate outside of our control. They may, at any time, change their terms of service and/or privacy policy with or without notice to you, or Kaylee Davis Fitness, LLC. In addition to those listed below, we may utilize other third party software products on an as needed basis. Please view the list below to learn more about the programs we disclose your information to and how it is used. 

  1. SugarWOD. This program is how our clients receive their workout, updates and any relevant news in regards to their fitness routine. Our clients are asked to download an application on their mobile device in order to get the latest on their workouts. This application is by SugarWOD. SugarWOD is a partner of ours and works to allow both coaches and athletes to communicate with one another on a more accessible level. 

  2. Mailchimp. This software acts as a marketing platform and email service. We use Mailchimp to store our clients information as it is given to us. Mailchimp is not a software that sells your personal information but rather acts as a communication channel between ‘Moms In Training’ and their clients. Mailchimp also allows for Kaylee Davis Fitness LLC to create campaigns and allows for analyzation of data as it relates to the Limited Liability Company. 

  3. HubSpot. This program acts as a customer relationship management program (CRM). Not only does HubSpot act as a CRM platform but also helps with marketing by helping to get new “leads” or potential new clients for Kaylee Davis Fitness LLC by viewing an internet user’s search history and, if applicable, connecting Kaylee Davis Fitness LLC to the lead. By HubSpot helping to get new leads, it is in no way selling your information. Collecting leads is just another functionality of HubSpot, aside from acting as a CRM. 

  4. ClickFunnels on Facebook. What this program does is allow Kaylee Davis Fitness LLC to create advertisements which will appear on Facebook. If someone is interested they are able to click on this advertisement and the user will be brought to the ‘Moms in Training’ sign up page where it will then collect the individual’s personal information as though they had not used an advertisement to get to the website page. ClickFunnels does not sell any of its users information but helps to connect a user with a business through advertisement. 

SECTION IV- HOW YOUR PERSONAL INFORMATION IS PROTECTED

We try our best to keep your personal information protected and frequently monitor our security. We have implemented measures for the purpose of securing your personal information from loss and unauthorized access. One way we protect our clients is by asking them to continually monitor their password and username and to change their password every couple of months. We also ask our clients to keep their passwords confidential as we want to avoid someone other than an authorized personnel accessing their account and possibly altering the account or making unwarranted purchases. 

SECTION V- HOW TO ACCESS/ CHANGE YOUR PERSONAL INFORMATION

In order to allow you to update or change any of your information you may have with us, we ask you to please email kaylee@momsintraining.net and you will be provided with assistance on updating your personal information. 

 SECTION VI- PRIVACY OF CHILDREN 

We do not intend any child under 13 years of age to use our website. Furthermore, we do not provide and have no intention of providing in the future, services to any child under the age of 13. It is important to us to keep the privacy of any child private and do not knowingly collect any personal information from any child. We are committed to abide with the Children’s Online Privacy Protection Act (COPPA) of 1998 . 

In the unlikely circumstance we come into the possession of  a child’s information we shall attempt to delete the information as soon as reasonably possible after becoming aware of the information belongs to a child under the age of 13. SECTION VII- COOKIES & OTHER TECHNOLOGIES

As is common on most websites, “cookies” and other technologies are used by our third- party software providers. The programs we utilize: SugarWOD, MailChimp, HubSpot and ClickFunnels all use cookies or other similar technologies to get a better understanding of their users. Cookies can be used by these companies to study and analyze traffic to our website as well as determine its effectiveness. 

By using the information gathered from the cookies and other similar technologies, these companies are able to better customize our user’s experiences when visiting our webpage. In no way is your information being sold, it is just being studied to better assist us in helping you have a more personable experience as a client of ours. 

SECTION VIII- UPDATES TO OUR PRIVACY POLICY 

In the event that there is an update to our privacy policy, you will be notified through the email we have on file for you. Within this email you will be notified of when the update will take effect, what the update is and how you will be affected by such update. However, it is your responsibility to ensure we have an up-to-date, active and deliverable email address for you which can be done by emailing kaylee@momsintraining.net to update  contact information

SECTION IX- PRIVACY POLICY FOR CALIFORNIA RESIDENTS 

Under the California Online Privacy Protection Act (CalOPPA), we are required to inform such individuals of the personal information we may collect.  CalOPPA is defined as the collection of personal information through the internet regarding an individual who is living in California. Some of the personal information we ask our users to give us, which would fall under CalOPPA would be email address, telephone number and birthdate. SECTION X- GDPR POLICY

Under the General Data Protection Regulation (GDPR), we are required to disclose individuals with the information regarding how their personal information is collected and processed for residents residing within the European Union (EU). Some of the types of personal information we collect would be email address, telephone number and birthdate. To view a complete list of the types of information we collect please refer back to “SECTION I.”

As Kaylee Davis Fitness LLC is a business entity located in the United States, individuals who reside out of the country and specifically within the EU will have their information transferred from the EU to the United States. These residents have the right to object to, or restrict the data processing, the right to erasure of personal information, and the right to data portability which allows individuals to obtain and use their personal information for their own uses on other platforms. Another right these individuals have are to be able to make a complaint with a local data protection authority. All these rights are specific to individuals within the EU and do not apply to individuals residing exclusively within the United States, or any other country not affiliated with the EU.
